5.8 The contract between FJF and the customer is concluded as soon as the customer receives FJF's acceptance of his order offer, which he sent via the website. 5.9 If one or more products are unavailable, the customer will receive an email duly informing them of the unavailability of the products. 6. Method of payment

6.3 The customer's credit card will only be debited after:
(i) verification of credit card details,
(ii) receiving authorization to charge the credit card from the customer's credit card provider and

6.4 At the time the order offer is sent, no charge will be made other than any preliminary charge that may be necessary to check the validity of the credit card. 7. Transport and delivery
7.1 The products must be delivered to the address specified by the customer in the order offer. The signature of the customer (or a named representative) is required upon delivery. The courier may require identification of the person collecting the package. FJF does not deliver to PO Boxes.
7.2 In the case of bank transfer, shipping takes place as soon as the transfer has been credited to FJF's account in freely available funds.
7.3 For each order, FJF will invoice the Customer for the Products by email or post in accordance with applicable laws and regulations. Invoicing is based on the data provided by the customer when ordering. After the invoice has been issued, no changes to the invoice are possible.
7.4 The customer bears the shipping costs. These are shown separately on the order and invoice.
7.5 The purchased products will be delivered by a courier service chosen by FJF, without any guarantee that the fastest and cheapest delivery will be chosen (hereinafter: “courier”); They will be delivered on working days (excluding Saturdays, Sundays and local or national holidays) within 30 (thirty) days from the date of order confirmation (except in cases of force majeure or unforeseeable circumstances). If delivery is not made within the time frame specified above, the Customer may request FJF by sending an email to info@fjf-jewellery.com a grace period of 7 (seven) days (or, if applicable, such other grace period as may be required by relevant applicable law). or reasonable in the circumstances) for the delivery of the product. (ii) that the packaging and its seal are intact, undamaged, not wet and have not been altered in any way.
Damage to the packaging and/or the product or discrepancies in the number of items or receipts must be noted immediately in writing on the courier's delivery note. To the extent permitted by applicable law, once the courier receipt has been properly signed, the Customer may no longer object to the external appearance of the package delivered, provided that the Customer may subsequently object to other product characteristics in accordance with the conditions in Section 13 below.
8. Shipping and Delivery Confirmation
8.1 FJF will send the customer a shipping confirmation by email once the products have been dispatched.
9. Wrapping Or Packaging
9.1 Products purchased through the Website will be delivered in the same standard FJF packaging as products purchased from an authorized reseller.
10. Right of withdrawal for consumers and its consequences according to the KSchG and FAGG
10.1 According to § 11 FAGG, the customer has the right to take possession of the products - or the last product in the case of a partial delivery - within 14 (fourteen) days from the date on which he (or his representative duly authorized to receive the products). to revoke the contract without giving reasons.
10.2 In order to exercise his right of withdrawal, the customer must inform FJF of his decision to withdraw from the contract with a clear statement (e.g. a letter by post, fax or email). The revocation does not require any specific form. Therefore, within the time frame mentioned in § 10.1 above, the Customer may send the following by email (see contact form) or by ordinary post:
• the attached cancellation form, which must be duly completed and signed, or
• a statement about his intention to make use of his right of withdrawal in accordance with Section 11 FAGG. This declaration must contain the following information: (i) the product in respect of which the customer wishes to exercise his right of withdrawal, (ii) the order number and (iii), if the customer has paid for the products by bank transfer, his IBAN number which the reimbursement has to be made.

10.3 The customer must return the purchased product to FJF JEWELLERY GmbH, Hauptplatz 28, 3300 Amstetten, Austria, within 14 (fourteen) days of the declaration of cancellation. The deadline is met if the customer sends the goods before the end of this period. The customer bears the direct costs of returning the product to FJF. The customer is only liable for any reduction in value of the products caused by use that goes beyond what is necessary to determine the nature, characteristics and function of the goods.
10.4 FJF will pay the customer all amounts paid by him, including the shipping costs (excluding additional costs due to the customer choosing a delivery other than the standard delivery offered by FJF), without culpable delay - in accordance with § 10.5 - but at the latest within 14 ( fourteen) days from receipt of the message that the customer is withdrawing from the contract. FJF will make the refund using the same payment method that the customer used for the original transaction, unless expressly agreed otherwise and provided that the customer does not incur any costs as a result of such refund.
10.5 Pursuant to Section 14 Paragraph 3 FAGG, FJF may withhold reimbursement until FJF receives the product back or until the customer provides proof that the product has been returned, whichever occurs earlier.
10.6 Products purchased via the Website cannot be returned or exchanged through authorized resellers.
10.7 Once the product has been dispatched, the order cannot be canceled or changed. However, shipped products can be returned as stated in Section 10.
10.8 If FJF does not comply with its information obligations in accordance with Section 4 Paragraph 1 Z 8 FAGG, the period for revocation is extended to twelve months, starting with the point in time in accordance with Section 10.1 If FJF fulfills its information obligations within this extended period, the period for exercise begins of the right of withdrawal according to § 10.1 at the time the information is transmitted by FJF.
11. Exceptions to the right of withdrawal
11.1 The customer has no right of withdrawal with regard to the contracts listed in Section 18 FAGG (available here).
12. Exchange of Products
12.1 Without prejudice to the Customer's rights under Sections 10 and 13, FJF in any case allows the Customer to exchange a Product purchased via the Website as follows:
(I) Upon receipt of the product, the customer must immediately contact FJF by email to the following address info@fjf-jewellery.com.
(II) The customer must fill out the form sent to him electronically after the withdrawal was announced, clearly indicating the product number and size of the new product he wants (the product numbers and sizes are indicated on the website).
(III) The product to be exchanged must be returned to FJF within 14 (fourteen) days from delivery in its original condition and using the form specified in § 12.1 (II) above. No labels must have been removed from the product. The customer bears the shipping costs for returning the product.
(IV) To reimburse the amount paid by the customer, FJF will use the same payment method that the customer used when making the purchase. The refund will be made within 14 (fourteen) days from FJF's receipt of the returned product;
(V) The exchange takes place under the condition that the desired new product is also available.
12.2 FJF treats the exchange as a new order from the customer. It is subject to the same conditions as the original order. These are included in these General Conditions.
13. Warranty

13.2 The warranty provisions of Sections 936ff ABGB and Section 8 KSchG apply to the sale of products. 13.3 If the customer requests a repair or exchange of the product due to defects in accordance with this § 13, FJF will bear the costs of returning the product to be repaired or exchanged as well as the costs of delivering the repaired or exchanged product to the customer.
14. Guarantee of Authenticity and Intellectual Property Rights
14.1 FJF guarantees the authenticity of all products purchased via the website.
14.2 The trademark “FJF JEWELERY” located on our products, related accessories and/or packaging, as well as trademarks consisting of forms of goods, together with all copyrighted images, images and objects that are the subject of industrial property rights and copyrights as well as all intellectual property rights remain the exclusive property of Mr. Florian-Julian Fichtinger, MBA.
15. Applicable Law and Place of Jurisdiction
